A firm protested a Navy contract award of a cost-plus-award-fee contract under a total small business set-aside, contending that: (1) the awardee's proposed cost was unrealistically low and the Navy must not have fairly compared the awardee's cost estimate to the gove (2) it had a lower cost than the awardee for the base-period requirement and should hav (3) the Navy's evaluation of its proposal was inconsistent with its evaluation in an and (4) this award, in addition to the other awards it had received, gave the awardee an unfair competitive advantage over it and other small business offerers on future solicitations. In addition, the protester requested that it be awarded bid preparation costs. The Navy contended that all of the protester's allegations were untimely since it provided the protester with sufficient information at the debriefing. GAO has held that: (1) a protester may delay the filing of its protest until after a debriefing when the information available earlier left uncertain whether there was any (2) a protest concerning matters of inconsistency in technical proposals should be filed within 10 days of the knowledge of the protest matter to
(3) it will not disturb an agency's cost evaluation unles and (4) although firms may enjoy a competitive advantage because of their own incumbency, such an advantage is unfair only where it results from a preference or unfair action on the part of the government. Accordingly, the protest was denied in part and dismissed in part and, because the protest had no merit, the claim for bid preparation costs was denied.
