一、凡在我省范围内举办各类幼儿园均应进行申办和审批。
二、审批机关为各县（市、区）人民政府教育行政部门。三、举办幼儿园，应具备以下条件：
1. 单位举办的，举办单位必须具有法人资格；个人举办者必须是享有政治权利、具有完全民事行为能力的中华人民共和国公民。
2.中外合作办园，华侨或港、澳、台同胞与内地合作办园，必须符合国家有关规定。
3.有稳定、可靠、合法的经费来源。
4.具备幼儿园设置的基本条件（见《浙江省幼儿园准办标准》中的相关条款）。
5.机构名称应当符合有关法律法规的规定，不得损害社会公共利益，不得冠以“全国”、“中国”、“中华”、“国际”等字样，不得使用易产生误导的词汇。已办幼儿园的园名中如有此类字样，在重新审核时应予以更正。幼儿园对外用名必须与教育行政部门审批同意的名称一致。
四、申请筹办幼儿园，申办者应当向所在县（市、区）教育局提交下列材料：
1.办园申请报告（原件），举办者的签字、印签，以及所在乡镇（街道）政府签署意见、盖章。
其中申请报告的内容应当包括：举办者、幼儿园名称与地址、培养目标、办园规模、办园形式、办园条件、内部管理体制、经费筹措与管理使用等。
2.举办者的资质证明（交复印件，验原件）。
举办者是个人的，须提供身份证及简历，注明现地址、联系方式，户口所在地（居住地）派出所出具的无犯罪记录证明（原件）；举办者是法人单位的，需提供单位营业执照（或单位法人证书）、组织机构代码证、税务登记证及法定代表人简历等（交复印件，验原件）。
